Yeah I don't think they can make such arangements, it seems more of a Gentleman's Agreement to me.
I think it is in the rules of the PL that a player on loan can't face the club that owns him.
We´ve signed him in January and have loaned him back for the rest of season I think so he´s ineligible.

We haven't signed him as far as I know. That article Amir says that we are his future employers. He's signed with us but, the official transfer won't happen till summer.
It's a precontract, not a loan ... There's nothing which forbids him playing against United in his contract clause, but the Premier League thinking it's a conflict.
Honestly a good performance against United would've put him in good stead, throwing the game would probably delay his progress at the club and see him get a heavy ban from the FA.

Scholes with any sort of injury wouldn't be good. Giggs is back next week but Scholes has been excellent in our central 3 and I'd expect him to play against Pool.
