It might set a precedent that we don't want to set. Might be good in the short term if we pay him off, but then every Bailly, Henderson, and VdB (at the least) will also start overplaying their hand.

If they want to unilaterally terminate that contract, then Maguire is within his rights to demand payment. The difference between his wage at West Ham and his wage at United equals the amount of his damages and he should be made whole. Having said that, I'm sure there will be a compromise and Maguire will go.
 
f he sees out his contract you'd think he's at risk of only getting an offer from the Championship, should mean his England career done too.

The contract is awarded based on him providing a service, usually in a normal contract there are performance requirements regarding level of service alongside the requirement to provide the service. This doesn't appear to be the same in football related contracts, and is obviously very subjective of course. In the real world there are mechanisms to terminate a normal contract for not providing the service to the level required, if we look at it that way is he providing the service that should be expected from a record signing, and very well remunerated, player? Arguably not.

So whereas you are right in that he can ask to be "made whole", it is very easy to argue that he doesn't deserve to be "made whole", since he ins't performing to a level that should be expected. He is lucky that contracts don't appear to have penalties for general performance related issues. So are the club though in reality, since if a player blows up the club could get multiple seasons at a cheaper rate than normal.

He is playing chicken with United. He has to be pretty stupid to think that sitting on the bench at this critical juncture of his career is a good move.

If he runs out his contract, he will land up being like Lingard, training at some former club in the summer and looking for a new contract.

He’s an employee given a contract by the club for extremely high wages. He’s about to sign one last contract which promises him lower wages. Why shouldn’t he seek a payout from the club? If your current employers wants to get rid of you, would any of the forum members happily leave their jobs without negotiating a decent severance?

Before raining the abuses, we should see him as a human being who’s asking for what he’s genuinely due. If as a professional, he decides to earn his bucks here than play at West Ham and strengthen his England case, the only reason he’s able to do that is because of our own incompetence.

Ultimately, I’m quite sure that a compromise will be reached and he’ll be off to West Ham. They can bluff all they want but they aren’t moving on to anyone else.

This is the worst news I could get yet today. With the shit midfield showcased last night, I’m now even more convinced this bloke should never leave the bench again- imagine how many circles the Wolves would’ve ran around this statue of a footballer.

Really bad taste in my mouth. We need dynamic players with strong mentality. Maguire is the perfect opposite.
 
So he gets rewarded for not being good enough?
He's being rewarded for not leaving Manchester United within a period of 6 years from the day on which he signed his contract. The fact that that stipulation is no longer one that United want to enforce is cost of doing business.
 
Maguire should be banished to the reserves, at least until the end of the window. No appearances on the bench. Don't give him hope. We need to show him the consequences more harshly.

You just know he'll still go to the Euros under Southgate if he's making the odd appearance off the bench. We need to remove that potential appearance, then see what Maguire thinks.

Let him disappear in the darkness until January, then just watch him cry for a move. Less money for us no doubt, but I just can't stand to have this deluded person as part of our squad any more!

Standard. No different to us loaning our players and still covering half their salary or if the the other club covers the entire salary then we get no or a very small loan fee. Or does anyone believe Martial played for free for Sevilla?
 
Future earnings are promised and the club now want to break the agreed contract to sell him on elsewhere. Therefore he is perfectly within his rights to negotiate terms to that contract being broken so he can go to another club. He has every right to expect Man Utd to pay him for it.

They don't want to break the agreed contract at all, They want to sell him which is well within their rights and if he is sold he isn't owed any payoff from Utd because he will be getting a new contract making ours void (like a new contract for higher wages a player might get mid contract for playing well, being sold for being crap to a lesser team on lower wages is basically the opposite and is what is going on here).

He is well within his rights to give up on his career and sit out his contract here for the rest of the money but don't make out he deserves the rest or even most of the remaining contract AND gets to move on to enjoy a new contract and challenge. You can't eat your cake and have it to.
 
Could we tear up his contract for gross misconduct? Was he ever prosecuted for what happened?
His retrial is in February.

That's another reason why we need to sell now, he doesn't have to attend but it's going to be an extra distraction for him and the club.
 
How can anyone rationalise paying him the remainder of his contract? You get paid the entirity of a contract when you see out the entire contract by being an employee and doing your job for the full length of it. If we sell him then he's no longer an employee and he'll have already have been paid what he's owed by United up until that point of leaving. Paying him off means he'll get paid wages he's not earned here on top of additional wages he'll be earning at his new club. It's pure fecking greed. If he wants to stay and be a backup player fine. If he wants to leave then he should accept a wage decrease befitting of his status and value to his new employer. He'll still be richer than 99% of the population ffs

Yes there are some legends in the game who play on half wages for their hometown team, but you can't expect that from anyone.
As a club, you have to set very strict standards for your wage structure. You can't leave those standards just because you need a guy desperately or it's late into the transfer window. If they don't want to play within those structures, just move on.
 
Euros are gone for Harry. No way he plays for England if he stays here. I think that is the only thing that might get him to move. I really don't get it.

Player power. If you are underperforming and not worth your wages you just sit your contract out. If you are over performing you demand a rise midway through your contract to prolong or hand in a transfer request and refuse to play if you are not sold.
